As a service provider, AIAgentur Dave is responsible for its own content in accordance with Section 7 (1) TMG. Responsibility for content, statements, and processed customer data within chatbot interactions on customer websites lies solely with the respective website operator. AIAgentur Dave provides the technical platform only and acts as a data processor within the meaning of the GDPR.
Liability for Links
No liability is assumed for external third-party websites. At the time of linking, no unlawful content was identifiable.

All content, websites, designs, AI configurations, and technical solutions created by AIAgentur Dave are protected by copyright. Use or distribution without written permission is not permitted.
Online Dispute Resolution (ODR)

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
General Terms and Conditions (GTC)
1. Contracting Party
The contract is concluded between the customer and:

2. Scope of Services
AIAgentur Dave provides services in the following areas:
Website development
AI-powered chatbots
Automation of inquiry and appointment processes
API integrations
Technical support and configuration
3. AI Act Compliance
In accordance with the EU Artificial Intelligence Act (effective August 1, 2024):
Risk classification: limited risk
Transparency obligations: all AI interactions are clearly identified
Documentation obligations: full logging of AI decisions
Human oversight: AI decisions can be reviewed by human staff
4. Data Protection and Data Processing
Personal data is processed exclusively in accordance with applicable data protection laws (GDPR, BDSG). Details are governed by the separate privacy policy.
Data processing: AIAgentur Dave acts as a processor pursuant to Art. 28 GDPR.
5. Subprocessors
The following service providers may be used:
BuildMyAgent.io – Shiney AI Inc., USA (platform hosting)
Mistral AI, France (EU-based language processing)
Make.com, Czech Republic (automation)
Brevo (Sendinblue), France (email delivery)
Google LLC, USA (email and calendar integrations)
For non-EU providers, data transfers are based on EU Standard Contractual Clauses pursuant to Art. 46 GDPR.
6. Liability
Liability is limited to intent and gross negligence.
No liability is assumed for:
Incorrect AI responses
Misinterpretation of AI communication
Errors caused by incorrect customer input
Downtime of third-party systems
7. Prices and Payment
All prices are net amounts pursuant to Section 19 UStG.
Invoices are payable within 14 days without deduction.
Late payments incur interest at 5% above the base interest rate per annum.
8. Final Provisions
Hungarian law applies.
Place of jurisdiction is Oroshaza, Hungary.
Amendments must be made in writing.
